Under Spanish law, the necessary elements of a contract (set out in Civil Code article 1278) are consent, the object (so you e.g. may not sell something you do not own), and consideration. In this respect, Spain is much like other European countries. But, important differences exist: for example, in Spain, if a party remains silent when it could and should have spoken out, that can be construed as consent.
